Magistrates Commission Launches Probe Into Retired Magistrate Tuletu Tonjeni After NPA Complaint
Investigation follows controversial ruling that saw high profile fraud case struck off the roll
The Magistrates Commission has formally launched an investigation into retired Senior Magistrate Tuletu Tonjeni following a complaint by the National Prosecuting Authority (NPA) over her handling of a controversial fraud and money laundering case involving taxi businessman Joe “Ferrari” Sibanyoni.
The inquiry marks the latest chapter in a legal saga that has drawn widespread criticism from prosecutors, legal experts and civil society organisations. At the heart of the investigation is Tonjeni’s decision to strike the case off the court roll after a state prosecutor failed to appear, a ruling that triggered outrage across South Africa’s justice system.
NPA spokesperson Kaiser Kganyago confirmed that the investigation officially began today.
The Magistrates Commission is expected to examine the circumstances surrounding Tonjeni’s decisions during the May 2026 court proceedings. Senior Prosecutor Mkhuseli Ntaba, who was found guilty of contempt of court during the same hearing, is expected to testify as part of the investigation.
The controversy dates back to a high profile hearing involving Sibanyoni and three co accused, who were facing charges linked to fraud, extortion and money laundering.
According to the state, the accused allegedly extorted approximately R2.2 million from a local businessman.
The courtroom drama unfolded after State Prosecutor Mkhuseli Ntaba failed to appear for scheduled bail proceedings. Reports at the time suggested members of the prosecution team had raised concerns about safety threats allegedly linked to the accused syndicate.
Rather than postponing proceedings, Tonjeni ruled that the repeated delays had become unreasonable. She struck the criminal case off the court roll and found Ntaba guilty of contempt of court, a move that immediately divided opinion within South Africa’s legal community.
The rulings were met with swift and sustained criticism.
The NPA lodged a formal complaint with the Magistrates Commission, alleging serious procedural irregularities. Among its concerns were claims that Tonjeni used inappropriate language during proceedings and exceeded her judicial authority by taking procedural steps that prosecutors argued fell outside the powers of the court.
The controversy extended beyond the courtroom.
The South African National Christian Forum (SANCF) publicly called on the Minister of Justice and Constitutional Development to investigate the circumstances surrounding the ruling. The organisation questioned whose interests had been served by the release of the accused and urged authorities to examine the matter thoroughly.
The NPA also moved quickly through the courts, applying for leave to appeal Tonjeni’s rulings in the High Court.
Shortly afterwards, the criminal case against Sibanyoni and his co accused was successfully re enrolled in the Delmas Regional Court, allowing the prosecution to continue despite the earlier setback.
Public attention intensified further when Tonjeni retired from the bench on 29 May 2026, only days after the NPA lodged its complaint with the Magistrates Commission.
Although she had formally notified authorities of her intention to retire during 2025, the timing of her departure attracted criticism from some observers, who argued that accountability questions remained unresolved.
The outcome of the Magistrates Commission’s investigation is now expected to determine whether any disciplinary findings will follow despite Tonjeni’s retirement.
The case continues to attract significant public interest as it raises broader questions about judicial accountability, prosecutorial independence and public confidence in South Africa’s criminal justice system.
