Vryheid House Robber and Rapist Handed Life Sentence After Leaving Phone Behind
The Vryheid Regional Court in KwaZulu-Natal has sentenced a 41-year-old man, Joseph Lebenya, to life imprisonment for rape and an additional five years for housebreaking.
The sentencing stems from a brutal incident on 17 December 2023 in Bhekuzulu Township, within the Vryheid policing precinct.
According to police reports, a 61-year-old woman was asleep in her home when she woke up to an intruder touching her.
The assailant, who had gained entry through a window, covered her mouth, undressed her, and raped her.
Following the assault, a physical altercation ensued between the victim and the suspect. During the struggle, the victim managed to seize the suspect’s jacket.
The attacker fled the scene, leaving the garment behind. Detectives later discovered the suspect’s mobile phone inside one of the jacket pockets.
The Vryheid Family Violence, Child Protection and Sexual Offences Unit (FCS) took over the docket. Using the phone and other recovered evidence, investigators positively identified Lebenya.
Although Lebenya initially fled the area, he was arrested on 15 May 2025.
The investigating officer successfully opposed bail, keeping him in custody throughout the trial.
The Vryheid Regional Court found Lebenya guilty on all charges, sentenced him to life behind bars, and declared him unfit to possess a firearm.
